The Office of the Director of Public Prosecutions was established following the promulgation of the Kenya Constitution on 28th August 2010. The independent Office of the Director of Public Prosecutions as spelt out by Article 157 of the Constitution; a. Have powers to direct the Inspector General of the National Police Service to investigate any information or allegations of criminal conduct b. Institute and undertake criminal proceedings against any person before any court of law c. Take over and continue with any criminal proceedings commenced in any court by any person or authority with permission of the person or authority d. Discontinue at any stage before judgement is delivered of any criminal proceedings with the permission of the court.
